Canada prepares to implement arbitration

The US-Canada arbitration provisions represent a turning point in cross-border transfer pricing negotiations between the two trading partners.

The provisions, which were included in the fifth protocol to the tax treaty between the two countries signed in September 2007, will be implemented on December 15 2010 and, in the run-up, both governments have been attempting to resolve as many cases as possible to avoid them going to arbitration.
