APA process in China fails to meet taxpayers’ needs despite breakthroughs

China completed its second bilateral advance pricing agreement (BAPA) in October. However, some transfer pricing professionals believe the process is not working properly.
The agreement, which was with an undisclosed jurisdiction, follows the first BAPA in August 2010 and took two years to complete. The BAPA was agreed for a Shanghai entity in the high-tech industry and was the first for a foreign invested commercial enterprise (FICE) operating in the Waigaoqiao Free Trade Zone.
