TPDoctor: Chinese documentation

May 18, 2009

My company has entities in China. What documentation requirements do I have to fulfil, and when?

Starting this year (applicable for FY2008 filings and onwards), Chinese companies are required to prepare and submit nine annual filing forms detailing their related party relationships, transactions, investments, financing and so on. This requirement has been part of China's TP legislation since the release of the CIT law in March 2007, which in article 43 stated that "forms for the annual reporting of related party transaction" would need to be completed. However it was not until a few months ago with the release of circulars 114 and 2 that the full details were available to taxpayers. The forms are officially required to be submitted with the annual tax filing, in other words by May 31, but local tax authorities have demonstrated leniency in some cases, and brought the filing deadline forward in others.
